You are stuck paying unless you can prove (very unlikely) that they did not live up to the written terms of the contract you signed. Hopefully you only have to pay a prorate amount based on the value of the phone and not the entire contact amount.

Cell companies will do anything to keep you under contract....Cell phone sales representatives.....car salespersons....debt collectors....They're all alike in that they'll tell you anything to get money/sales from you....Any verbal promise from them that is not backed up in writing is worthless.
