I installed a lock on my bedroom to protect my belongings. One night last week I left the key on the lock when I went to sleep. In the middle of night she stole my key and the noise woke me up. I asked her to give my keys back. I eventually called the police and I got the keys. Then today to my supprise, the police deliveried a restraining order and asked me to leave the house because she told the court that I attacked her. I am not sure why the judge can do it without seeing proof or hearing my side of story. But I will have to go to court next week. Could anyone tell me if will be able to go back after I tell the truth? What's the worst? thx.What can I do with Restraining order based on false information?
You can actually deny the order. I don't know the details but one was served on a girl I know and she refused it and so it didn't go into affect. Good luck!What can I do with Restraining order based on false information?
Where I live no judge would issue such an order with out evidence and further more a restraining order can not be refused.
Hard to believe the judge would issue such an order based only on her word. Are there only two of you in the apartment? Are there any other witnesses? If she says you attacked her, she would likely have some sort of injuries (at least bruises) but if you have to wait a week to go to court, those could disappear naturally, and the fact she has no sign of injury at that time wouldn't mean that you had not injured her. Contact a lawyer and find out if you can insist that she present herself to a doctor for inspection NOW to prove whether or not she shows any sign of assault.
ok, they can get a restraining, on you until you go to court and she has to have evidence that you hit her, but if you can prove it wrong,(which you can) she will be thrown into jail for False Information to the police. She has to have photos and better evidence where u would of hit her. I hope this helps you out!
